Use of user generated content
By responding:
#YesHB on Instagram or Twitter or providing blanket written (digital and print) consent to any images you share from your social channels that use #MyHB, #Hollandandbarrett or #CleanerBeauty in description
You agree to the following:
You grant Holland & Barrett, its affiliates and/or related entities (collectively “Holland & Barrett”) a worldwide, perpetual, irrevocable, royalty-free, non-exclusive, transferable right to use your video(s), photo(s) and/or other content posted to Instagram or Twitter together with your social media handle, social media user name, profile picture, caption and location information you may have included in your content (“User Content”) in any media, including but not limited to its webpages, social media pages, emails, digital advertising, retailer sites, third party sites, stores for its marketing and/or its advertising both print and digital.
You grant Holland & Barrett the right to use your username, real name, image, likeness or other identifying information in connection with any use of your User Content.
Holland & Barrett may use, display, reproduce, distribute, transmit, combine with other materials, alter and/or edit the User Content for legal and/or regulatory reasons in any way it sees fit (while maintaining the original sentiment), with no obligation to you whatsoever.
You confirm and agree that:
(i) you own all the rights in the User Content and/or that you have permission from any person(s) appearing in the User Content to grant the rights herein;
- (ii) you and all other person(s) appearing in the User Content are not under 16; and
- (iii) Holland & Barrett’s use of your User Content will not break any law or violate the rights of a third party. Holland & Barrett has the right to disclose your identity to any third party who claims that the User Content infringes their rights.
You warrant that your User Content is truthful and accurate and that it does not misleadingly exaggerate the effect any Holland & Barrett product(s) are capable of achieving (whether through pre-production techniques (including lash inserts, hair extensions etc) or post-production techniques (including filtering, retouching or editing etc)).
You consent to Holland & Barrett’s collection of any personal information you provide, and Holland & Barrett’s use and disclosure of that personal information in connection with the use of your User Content as described above. Your personal information may be transferred to or accessible from outside the EEA, and may be shared with affiliates or other trusted third parties working on Holland & Barrett’s behalf. By posting User Content with any Hashtag(s) defined below or otherwise providing Holland & Barrett with personal information, you agree to such collection, use, disclosure, transfer and processing of your information in accordance with these Terms and Conditions, Holland & Barrett’s Privacy Policy, and applicable data protection laws and regulations.
You will not hold Holland & Barrett, or any person acting on Holland & Barrett’s behalf, responsible for any claims or demands in connection with the use of your User Content.
You accept that Holland & Barrett will not pay you for the use of your User Content and/or for any intellectual property rights connected with them.
You accept that Holland & Barrett may refuse to use or remove your User Content for any reason.
If you change your mind about sharing your User Content, or you do not want Holland & Barrett to contact you about User Content again, please opt out by contacting our customer services team.
Holland & Barrett reserves the right to alter these Terms and Conditions without warning.
H&B Jill Scott Prize Draw Terms & Conditions:
Acceptance. By entering this promotion, you are deemed to have accepted, and will be bound by, these terms and conditions.
Eligibility. This prize draw is open to all UK residents aged 18 or over. This prize draw is not open to employees of the promoter, Holland & Barrett or any of its subsidiary companies, their families, agencies, or anyone else professionally connected with this promotion, or any employees of Comic Relief.
Prize draw period. This prize draw opens at 00:00 on June 19 2024 and closes at 23.59 on July 30 2024. Entries received after this time will not be entered into the prize draw.
Entry requirements. Share a video doing one of Jill Scott’s Movement Movement challenges to Instagram or TikTok using the hashtag #TheMovementMovement and tag @hollandandbarrett.
Winner selection. One winner will be selected within 48 hours of the competition closing. Winner will be selected at random from all valid entries by Holland & Barrett. Holland & Barrett’s decision is final. The winner will be informed of their prize by a social media comment and private message. The Winner will have 5 working days from initial contact by the Promoter to respond confirming compliance with these terms and eligibility to win their prize. If a winner does not respond with appropriate confirmation within the specified timeframe that winner will be disqualified, and the prize will be offered to a reserve winner selected in a prize draw.
Prize. The following prize is available: An afternoon for two with Lioness Jill Scott MBE including lunch at BOXX2BOXX Coffee in Wythenshawe and a 1-hour training/movement session.
The prize is non-transferable and cannot be sold or auctioned. No cash or other alternative prize will be offered.
We accept no responsibility for failed arrangement of prize due to the provision of incorrect contact details by you.
The prize must be redeemed by a date provided by Jill Scott and is subject to Jill Scott’s availability.
Holland & Barrett will cover train travel for the winner and guest from anywhere in the UK to Wythenshawe.
Limitation of liability. To the extent permitted by law, we accept no liability for any damage, loss or injury suffered (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way due to entering this prize draw or taking up a prize. We are not responsible for third-party acts or omissions.
Intellectual property. You will retain ownership of any content, submissions and other material that you submit as part of this prize draw. However, you grant us (and our agents and affiliates) a non-exclusive, royalty free, worldwide, irrevocable, perpetual licence to use any such content, submissions and other material for the purposes of this promotion.
Publicity. The winners may be asked to take part in publicity relating to this promotion but this will be discussed with the winners before taking place.
Winner’s name. In accordance with the Advertising Standards Authority CAP Code, we intend to publish or make available the surname and county of any winner. Any winner that objects must notify us as soon as possible after you are informed that you have won.
General terms. No bulk or third-party entries will be accepted. In the event of multiple entries being received from the same person or account, only the first entry will be accepted.
We reserve the right to disqualify incomplete, altered or illegible entries. No responsibility will be accepted for entries lost, damaged or delayed, technical or telecommunications faults. Proof of submitting is not proof of receipt.
We reserve the right, in our absolute discretion, to verify the winner, including, but not limited to, proof of identity and/or age, as required, and to withdraw a prize where there are reasonable grounds to believe there has been a breach of these terms and conditions or otherwise where an entrant has gained advantage in participating in the promotion or has won using fraudulent means.
Our decision is binding in all matters relating to this promotion, and no correspondence shall be entered into.
Owing to exceptional circumstances outside our reasonable control and only where circumstances make this unavoidable, we reserve the right to cancel or amend the promotion or these terms and conditions at any time, but will always endeavour to minimise the effect to you in order to avoid undue disappointment.
Governing law & jurisdiction. These terms and conditions (and any non-contractual disputes/claims which arise out of or in connection with them) will be governed by English law and we and you submit to the exclusive jurisdiction of the English courts.
This promotion is in no way sponsored, endorsed, administered by or associated with any of the social media platforms where the post promoting the promotion is featured. None of the social media platforms are responsible to entrants in respect of any aspects of this promotion.
